Creating A Custodial Agreement

There are a number of ways to establish a custodial agreement. It is always best for the parties to reach an agreement outside of court through negotiations. Any issues that cannot be agreed upon will be decided by the court.

While many law firms encourage clients to use mediation, we do not recommend it unless each party has a separate attorney representing their interests. It is often not as efficient, simple or inexpensive as many would have you believe, and there are significant risks involved. In particular, mediators are not concerned with the law or what is fair.

We can negotiate a custodial agreement that will work for you and your child, and if your case has to go to trial, we will protect your interests in the courtroom.

Some of the challenges include:

  • Lack of trained legal experts representing divorcing spouses’ interests
  • Lack of firm rules for mediators
  • Lack of mandatory full financial disclosure

These are just a few of the risks involved with mediation for divorcing couples. In addition, mediation is not a healthy environment if there has been any instance of domestic violence in the marriage.
