'Conscious uncoupling' vs. divorce

Earlier this week, actress Gwyneth Paltrow posted a statement to her website in which she announced that she and her husband, Coldplay frontman Chris Martin, had decided to divorce. However, she did not actually use the term ‘divorce.’ Instead, she referred to the split as a ‘conscious uncoupling,’ a term that may have caused more of a stir than the divorce announcement itself. What, exactly, is a conscious uncoupling, many wondered, and how is that difference from a divorce?

How are stock options divided in divorce?

Whether you have millions in assets or significant debt (or are somewhere in between), determining how to divide up your financial portfolio can be one of the most complicated parts of your divorce. The process can become more complex when you or your spouse have assets that are difficult to appraise and evaluate, such as stock options and restricted stock.

Should New York fathers have delivery room rights?

A recent landmark case from a neighboring state has many New York residents thinking about the rights of fathers in our state. It is an interesting question: should mothers be able to ban fathers from the delivery room and, in doing so, prevent them from being present at their child’s birth?

Man falsifies bankruptcy to avoid paying child support

Let this be a cautionary tale for our New York readers: if you are attempting to avoid paying child support by hiding assets and fraudulently filing for bankruptcy, it is probably not the best idea to voluntarily get the FBI involved in your case. If you do, you will likely have to pay not only the child support that you owe, but much more in the form of restitution, fines and even jail time.

Overnight guests could impact your child custody case

If you have been suffering through an unhappy marriage for months or even years, it may be incredibly liberating when you finally separate from your spouse and are able to live freely on your own. However, it is important to remember that all of your actions could potentially affect the outcome of your child custody case. One example of this is overnight guests, as discussed in a recent Huffington Post article.

Did the recession force New Yorkers to put divorce on hold?

According to recent data from the New York State Department of Health, there were 58,792 divorces and annulments in the state in 2012. This is a 17 percent increase from 2009, when just over 50,000 marriages ended. For many, that jump is not a surprise. In 2009, New York and the country were in the throes of the worst recession in recent history, which caused home values to plummet and layoffs to skyrocket.
