Fathers’ rights and divorce: why you need your own attorney

Divorce can take a toll on children, especially when one parent may not be able to see his or her kids as often as he or she would like. Unfortunately, some parents have a difficult time maintaining their relationship with their kids after the divorce. 

Despite laws in New York that encourage child custody and visitation agreements to provide both parents with equal opportunities to spend time with their children, many fathers still struggle with being able to spend time with their children after the divorce. 

Many fathers may feel like they don’t have the same rights as their ex, but laws in New York do not discriminate against parents based on their sex. Many fathers want to stay involved in their child’s life, which includes not only spending time with them but also being able to have a say in their education, health care and religion. 

Due to the complexities involved with child custody and visitation agreements, it is best for fathers getting divorced to have their own divorce attorney. Having your own attorney will help you understand the divorce process and how child custody, child support and property division decisions are made. 

Having your own divorce attorney can help reduce the stress of getting divorced, especially when you have children. Individuals should have their own attorney to discuss what mistakes to avoid during settlement negotiations. A divorce attorney can also make sure all divorce documents are reviewed and accurate according to the agreement made with your ex. 

While many fathers may view the divorce process as challenging and difficult, it doesn’t have to be. Making sure you have your own attorney and discussing what considerations to make during the divorce proceedings can protect your rights as a father and hopefully lead to a better family relationship once the divorce is finalized.
